United States

Under 19 CFR § 133.21(b)(1), US Customs and Border Protection (CBP) has detention authority:

“CBP may detain any article of domestic or foreign manufacture imported into the United States that bears a mark suspected by CBP of being a counterfeit version of a mark that is registered with the U.S. Patent and Trademark Office and is recorded with CBP pursuant to subpart A of this part. The detention will be for a period of up to 30 days from the date on which the merchandise is presented for examination.”

Under 19 CFR § 133.21(e), CBP may seize and forfeit goods:

“Upon a determination by CBP, made any time after the merchandise has been presented for examination, that an article of domestic or foreign manufacture imported into the United States bears a counterfeit mark, CBP will seize such merchandise and, in the absence of the written consent of the owner of the recorded mark, forfeit the seized merchandise in accordance with the customs laws.”

European Union

Under Regulation (EU) No 608/2013, Article 17, customs authorities may hold goods:

“Where the customs authorities identify goods suspected of infringing an intellectual property right covered by a decision granting an application, they shall suspend the release of the goods or detain them.”

Regulation (EU) No 608/2013, Recital 4 provides a personal luggage exception:

“This Regulation should not apply to goods carried by passengers in their personal luggage provided that those goods are for their own personal use and there are no indications that commercial traffic is involved.”

Canada

Under the Trademarks Act R.S.C. 1985, c. T‑13, section 51.03(1):

“Goods shall not be imported or exported if the goods or their labels or packaging bear, without the consent of the owner of a registered trademark for such goods, a trademark that is identical to, or that cannot be distinguished in its essential aspects from, that registered trademark.”

Section 51.03(2)(c) of the same Act states the prohibition does not apply if:

“the goods are imported or exported by an individual in their possession or baggage and the circumstances, including the number of goods, indicate that the goods are intended only for their personal use.”

United Kingdom

Under the Trade Marks Act 1994, section 89(1) and (2), a trade mark owner can request that customs treat infringing goods as prohibited. Section 89(1) states:

“The proprietor of a registered trade mark, or a licensee, may give notice in writing to the Commissioners of Customs and Excise (a) that he is the proprietor or, as the case may be, a licensee of the registered trade mark, b that, at a time and place specified in the notice, goods which are, in relation to that registered trade mark, infringing goods, material or articles are expected to arrive in the United Kingdom (i) from outside the European Economic Area, or (ii) from within that Area but not having been entered for free circulation, and c that he requests the Commissioners to treat them as prohibited goods.”

Section 89(2) states:

“When a notice is in force under this section the importation of the goods to which the notice relates, otherwise than by a person for his private and domestic use, is prohibited; but a person is not by reason of the prohibition liable to any penalty other than forfeiture of the goods.”
